TERMS OF SERVICE

The short version: M&B ELITE is a paid fitness membership. It renews automatically until you cancel, you can cancel any time and keep access through the period you paid for, and the training and nutrition guidance is general information, not medical advice. The details are below and in our Refund & Cancellation Policy and Privacy Policy.

1. Agreement

These Terms of Service (“Terms”) govern your use of the M&B ELITE website and app (the “Service”), operated by M&B ELITE (“we”, “us”). By creating an account, subscribing, or using the Service, you agree to these Terms, the Privacy Policy, and the Refund & Cancellation Policy. If you do not agree, do not use the Service.

2. Who can use M&B ELITE

You must be at least 18 years old to create an account or subscribe. By using the Service you confirm that you are 18 or older and that the information you give us is accurate.

3. Your account

You sign in with your email address and a password, and you may need to confirm your email. You are responsible for keeping your login secure and for activity under your account. Do not share your account with others. Tell us promptly if you think your account has been accessed without permission.

4. Membership, billing and renewal

Paid membership. Access to the training, nutrition, progress, coaching and community features requires an active paid membership (or complimentary access that we have granted to you). You can choose a monthly or yearly plan at checkout. The price and billing period are shown before you pay.
Automatic renewal. Your membership renews automatically at the end of each billing period at the then-current price for your plan, and your payment method is charged, until you cancel.
Payments. Payments are processed by Stripe. We do not see or store your full card number. Applicable taxes, if any, are added at checkout.
Cancelling. You can cancel at any time from Billing (“Manage billing & subscription”). Cancellation stops future renewals; you keep access until the end of the billing period you have already paid for. See the Refund & Cancellation Policy for details, including refunds.
Failed payments. If a renewal payment fails, we or our payment provider may retry it. Your access may continue for the remainder of the period already paid for, and ends if payment is not completed.
Price changes. If we change the price of your plan, we will notify you in advance. The new price applies from your next renewal after that notice, and you can cancel before then.
Founding Member pricing. Founding Member pricing is offered to a limited number of early members. It applies only while your founding subscription stays continuously active. If that subscription fully ends (for example, you cancel and the paid period expires, or it ends for non-payment), the founding price is no longer available, and standard pricing applies if you rejoin. Your Founding Member recognition remains.
Complimentary access. Some members have access that we granted without a subscription. That access has no billing and is otherwise subject to these Terms.

5. Fitness, nutrition and health disclaimer

M&B ELITE provides general fitness and nutrition information for educational purposes. It is not medical advice, and it does not create a doctor–patient, dietitian–client or trainer–client relationship.

Talk to a qualified healthcare professional before starting any exercise or nutrition programme, especially if you are pregnant, have a medical condition or injury, take medication, or have not exercised recently.
Exercise carries a risk of injury. You choose to take part at your own risk. Stop immediately and seek medical help if you feel pain, dizziness, shortness of breath or anything unusual. In an emergency, contact your local emergency services.
Workout plans, calorie and macro targets, and coaching content are general and are generated from the information you provide. They may not suit your circumstances, and results vary and are not guaranteed.
Calorie, weight, body-measurement and progress figures are estimates and tracking tools, not diagnoses.

6. Acceptable use

You agree not to: share, resell or publish your account or our content; copy, scrape, reverse-engineer or interfere with the Service; attempt to access other members’ data or bypass access controls or payment; use the Service for anything unlawful; or post content in community areas that is abusive, harassing, misleading or infringes others’ rights. We may remove content and suspend or end accounts that break these rules.

7. Our content and your content

The Service, including its workouts, programming, text, images, video, design and software, belongs to M&B ELITE or its licensors and is protected by law. We give you a personal, non-exclusive, non-transferable licence to use it for your own non-commercial training while your access is active.

You keep ownership of what you provide (your profile, logs and any community posts). You give us permission to store and process it to run the Service for you. If you post in community areas, you also give us permission to display it to other members there.

8. Third-party services

The Service relies on providers such as Stripe (payments), Supabase (accounts and data storage), Netlify (hosting), and email and form services. Their own terms and privacy practices apply to their services. See our Privacy Policy.

9. Suspension and termination

You may stop using the Service and cancel at any time. We may suspend or terminate access if you break these Terms, if your payment fails, or if needed to protect the Service or other members. If we terminate your access for a reason other than your breach, we will refund the unused part of any period you already paid for.

10. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not promise that the Service will be uninterrupted, error-free or that it will produce any particular result.

11. Limitation of liability

To the fullest extent permitted by law, M&B ELITE and its operators will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or revenue, or for injury arising from your exercise or nutrition choices. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose. Nothing in these Terms limits liability that cannot be limited by law or any rights you have under mandatory consumer law.

12. Changes to these Terms

We may update these Terms from time to time. We will post the new version here with a new “Last updated” date and, for material changes, give notice through the Service or by email. Continuing to use the Service after the change takes effect means you accept it.
